This document is published by the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 which require publishing the rules and regulations, privacy policy, and the terms and conditions for access or usage of www.Worldshadi.com (the "Website/app").

Worldshadi.com is your matchmaking service provider. This agreement sets out the legally binding terms for your use of the site and membership. This agreement may be modified by Worldshadi.com from time to time. The membership and rights of admissions are reserved.

Access to the worldshadi.com website and application is free. However, we offer premium membership plans to promote his/her profile on the website. This site is a serious matchmaking platform to seek a life partner for marriage and is not a casual dating site.

1.     Acceptance of Terms of Use Agreement

You must understand and acknowledge order to use Worldshadi.com is a service provider and you must register as a member on the Website/community sites/mobile applications (“Site”). Worldshadi.com is an intermediary as defined under sub-clause(W) of section 2 of the information technology act, 2000.

Worldshadi.com acts as a platform to enable any user to themselves register on it (by filling the mandatory fields and optional fields, if any) to voluntarily search for profile(s) from the database of WS’s already registered users, for seeking prospective lawful matrimonial alliances for themselves. Worldshadi.com retail store may also be able to assist you to create your profile, however, you must have a valid/operational mobile phone number and an email id. The profiles in the database of SW are classified broadly based on language and region for the ease and convenience of its members/customer. WS Members are provided with free/paid access for searching profiles from the database of WS, as per the partner preference set by you (on the Website/Applications -(App) and you can shortlist the profiles in which you are interested.

2.     Eligibility

A.    Worldshadi Membership and rights of admission are reserved:

               I.         Indian Citizens

              II.         Person of Indian origin

             III.         NRI

             IV.         Person who wants to marry persons of Indian origin

            B.     you confirm that you are a member of worldshadi

              I.         above 18 if you are a woman or above 21 if you are a Man.

             II.         If you have applied for Divorce, you may register on the Website/App by stating “Awaiting Divorce”.

            III.         If you are a resident of any other country, you are legally competent to marry as per the local rules applicable to your country                          and you shall comply with the Indian laws for marrying a person of Indian Origin

            C.     If you create someone else's profile on the Worldsadi.com (Website/App) or if you are accessing the Worldsadi.com website/app on their behalf, So this means that you have taken their consent to create their profile and have also taken permission to use it.

3.     Account Security

You are responsible for maintaining the confidentiality of the login credentials you designate during the registration process, and you are solely responsible for all activities that occur under your account. You agree to immediately notify us of any disclosure or unauthorized use of your account or any other breach of security, and ensure that you log out from your account at the end of each session

4.     Term and Termination

A.    As long as you use our site, this agreement will be effective, valid, and in existence.

B.     You can terminate your membership at any time, for any reason by writing to WorldShadi.com. If you terminate your membership, you will not be entitled to a refund of any unused membership fees, if any, that may have been paid by you, except as otherwise guaranteed in writing.

C.     WorldShadi.com may terminate your access or membership at any time for any reason including but not limited to violation of our terms. If WorldShadi.com terminates your membership for breach of terms of this Agreement, you will not be entitled to any refund of any Subscription fees, if any, paid by you.

D.    Certain provisions of this Agreement including sections 4, 5, 6, 7, and sections 9 to 16, of this Agreement, shall remain effective even on termination.

E.     Term for the paid Membership would be by the type of membership undertaken.

F.     In the event of business discontinuity, the Company shall refund 50% of the unused membership fees paid by you.

5.     Non-Commercial Use by Members

Worldshadi.com website and app are for the personal use of individual members to advertise and promote their profiles to generate accepts from relevant matches and cannot be used in connection with any commercial endeavors. This includes providing links to other websites, whether deemed competitive to Shadi.com or otherwise. Organizations, companies, and/or businesses cannot become Members of worldShadi.com and should not use the worldShadi.com Service or Site for any purpose. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

6.     Other Terms of Use for Members

A.    Worldshadi.com have the right to block your account in case we find any violation of terms or activity and status of each account.

B.     worldShadi.com reserve the right at its sole discretion to restrict/suspend your free access to its website based on the review of the member's activity, status, or any such criteria worldShadi.com may deem fit and proper with due intimation to you.

C.     You hereby confirm that as of the date of this registration, you do not have any objection to receiving emails, SMS/WhatsApp messages, and calls from worldShadi.com and members of worldShadi.com as long as you are a registered member of worldShadi.com including SMS permission for authenticating mobile verification want transactions via OTP, sent by the Payment Gateway. This consent shall supersede any preferences set by you with or registration is done with the Do Not Disturb (DND Register)/ National Customer Preference Register (NCPR). This consent extends to emails, messages or calls relating but not limited to phone number verification, the provision of matchmaking advertising service, matchmaking inquiries, and promotions.

D.    Multiple profiles of the same person are not allowed on our Site. worldShadi.com reserves the right to deactivate all multiple profiles without any refund of subscription fees.

E.     You confirm that the Content, information including the personal information provided by you is correct and accurate. If you are creating the profile on behalf of your friend/sibling/children, you hereby agree that you have the required permission from the particular person whose profile is created on worldShadi.com by you. Impersonation is a crime and punishable under various laws.

F.     You are strongly advised to submit a copy of your Driving License, Passport, or any other Government-issued identity and add a trust badge to your profile.

G.    Except to promote/advertise your profile for matchmaking purposes, you cannot engage in advertising to or solicitation of, other Members to buy or sell any products or services through the Service.

H.    You will not transmit any chain letters or junk emails to other worldShadi.com Members. Although worldShadi.com cannot monitor the conduct of its Members off the worldShadi.com Site, it is also a violation of these rules to use any information obtained from other members to harass, abuse, or harm another person, or to advertise to, solicit, or sell to any Member without their prior explicit consent.

I.      worldShadi.com reserves the right to take appropriate steps to protect worldShadi.com and/or its Members from any abuse/misuse as it deems appropriate in its sole discretion.

J.      You hereby agree that you shall not use the Services and the platforms to harass any member including the Shaadi meet/Near Me feature.

K.     You cannot use any automated processes, including IRC Bots, EXEs, CGEXEsany other programs/scripts to view content on or communicate / contact/respond / interact with Shadi.com and/or its members.

L.     worldShadi.com reserves the right to screen communications/advertisements that you may send to other Member(s) and also regulate the same by deleting unwarranted/obscene communications/advertisements at any time at its sole discretion without prior notice to any Member.

M.   worldShadi.com Members are expected to exercise simple precautions for their privacy and safety. A suggestive guideline of such precautions is enlisted under security tips "Be Safe Online". By becoming a Member you hereby agree to read, abide and adhere to the said Tips.

N.    worldShadi.com Members who subscribe to the worldShadi.com Select Service hereby, unconditionally and irrevocably confirm that you have read the terms and conditions and agree to abide by them.

7.     Proprietary Rights in the Content on WorldShadi.com

WorldShadi.com owns and retains all proprietary rights in the WorldShadi.com Site and the WorldShadi.com Service. The Site contains the copyrighted material, trademarks, and other proprietary information of WorldShadi.com, and its licensors. Except for that information that is in the public domain such as a member profile or for which permission has been obtained from the user, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by WorldShadi.com without refund of any of your unused Subscription fees. WorldShadi.com reserves right to take legal action (civil and/or criminal) wherever applicable for any violations.

8.     Content Posted on the Site

You understand and agree that WorldShadi.com may delete any listing, content, communication, photos or profiles (collectively, "Content") that in the sole judgment of WorldShadi.com violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either WorldShadi.com and/or its Members. You understand and hereby agree that all information, data, text, photographs, graphics, communications, tags, or other Content whether publicly posted or privately transmitted or otherwise made available to worldShadi.com are the sole responsibility of the person from whom such Content originated and shall be at the member's/person's sole risks and consequences. This means that you (and not worldShadi.com) are solely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.

WorldShadi.com reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, WorldShadi.com may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence to the satisfaction of worldShadi.com, worldShadi.com may, in its sole discretion, terminate your Membership without a refund.

The following is an indicative list of the kind of Content that is illegal or prohibited on the Site. worldShadi.com will investigate and take appropriate legal action against anyone who violates this Agreement

A.    is bluntly offensive to the community, such as Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.

B.     harasses or advocates harassment of another person.

C.     involves the transmission of "junk mail", "chain letters," unsolicited mass mailing, or "spamming".

D.    promotes information that you know is false, misleading, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.

E.     displays pornographic or sexually explicit material of any kind.

F.     provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.

G.    provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.

H.    Engagingg’s in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

I.      You must use the WorldShadi.com Service in a manner consistent with any and all applicable local, state, and federal laws, rules, and regulations.

J.      You cannot include in your Member profile, visible to other members, any telephone numbers, street addresses, URL's, and email addresses.

9.     Your Interaction with other Members & Member Disputes

You are solely responsible for your advertisement/communications with other worldShadi.com Members. worldShadi.com reserves the right but has no obligation, to monitor disputes between you and other Members. worldShadi.com also reserves the right to take appropriate action against errant members. However, worldShadi.com is not obliged to share such action with other members, including complaints. worldShadi.com expressly disclaims any responsibility or liability for any transactions or interactions between the members.

10.  Disclaimer

 A.    Your access to and use of the WS Services or any content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE WS SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, WS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WS does not warrant that the Website/App, its servers, or e-mail sent from WS are free of viruses or other harmful components. WS will not be liable for any damages of any kind arising from the use of this WS Website/App, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

 B.     WS does not give any implied or explicit guarantee or warranty of marriage or alliance by you choosing to register on our Website/App and using WS services (both paid and free).

 C.     Notwithstanding anything contrary contained anywhere, under no circumstances, WS shall be held responsible or liable whatsoever or howsoever, arising out of, relating to or connected with:

      i.   any act or omission done by WS/payment gateway/alliance partner etc.;

      ii.  any untrue or incorrect information submitted by you or on your behalf;

     iii.  any decision taken by you or on your behalf or any consequences thereof, based on any information provided by any other user (including                        suspension/deletion of the profile from WS);

      iv. any unauthorized or illegal act done by any third party relating to or connected with any information submitted by you or on your behalf;

       v. any cybercrime attempted or committed by anyone and

     vi.  any incident of force-majeure or 'act of god'.

     vii. Any issue already stated in these terms and conditions including limitation of liability clause of these terms and conditions.

     viii. Using/availing third-party services namely horoscope matching services etc. and for paying them through the Website.

      ix. WS shall not be liable for the outcome of during any interaction in a meeting, call, sms, chat, email or social media posts at any point of time

      x.  Any issues relating to any technical malfunction of any telecommunication network, software, hardware failures, network congestion, denial of                  service, failure due to spamming or any combination of the above.

12.  Once your paid membership expires, you cannot avail the unexpired balance phone call count/ unexpired SMS . Similarly, you cannot access the already viewed worldshadi.com member(s) contact information unless you renew your account within 30 days

13.  Assisted Service Guarantee is applicable only for the users

                  A.    Who has availed of the Assisted Service for the first time.

B.     Who have more than 100 matching profiles based on the partner preference set by them at the time of the Assisted Welcome Call.

C.     Who have not narrowed down the partner preference, once the Assisted service starts

14.  Jurisdiction

If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Mumbai, India only.

15.  Limitation on Liability

In no event will WorldShadi.com be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the Site or the worldShadi.com Service, even if worldShadi.com has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, worldShadi.com liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to worldShadi.com, for the Service during the term of membership.
